The court-ordered 24-hour special care service is a freedom-restricting measure which is used as a last resort. An adult may be placed in a 24-hour special care facility without their consent for up to one year if all of the following circumstances apply:
- The adult has a severe psychological disorder that limits their ability to understand or control their behaviour
- The adult will pose a danger to themselves or others if they are not placed in a care facility to receive 24-hour special care services
- Previous support measures have proven insufficient, or implementing other support measures is impossible
The process of referring the individual to the service by court order is initiated by the local government.
If the circumstances that led to the referral have not changed after one year, the court may extend the service period in increments of up to one year. Such extension is based on a request submitted by the municipal or city government of the person’s place of residence or by their legal representative.We provide the court-ordered 24-hour special care service for individuals with psychological disorders in Tallinn and Sillamäe.
